Terms & Conditions

CONTENTS

Enquiries and Bookings:

1. Send us an email or call us with your preferred charter date, boat type, number of guests, budget, any extra services needed and event type

*Note, boat prices are seasonal and are based on the boat type and  brand. 

2. NextWave Charters will send suggested boats based on your requirements and a quotation.

3. Once details are confirmed, an invoice will be issued.

4. To secure the booking and boat, a 50% deposit is required. Until this payment is received, your booking cannot be confirmed. Please send a copy of the payment slip, to help verify your payment. 
5. If booking made less than 7 days before the charter full payment is required.
6. Final remaining payment for the charters and full payment for extra services must be received at the latest of 7 day prior to the charter.

7. Any additional services (eg. catering, beverages, speedboat, etc), must be arranged a minimum of 14 days prior to the charter. In cases where there is less than 14 days, NextWave will make every effort to accommodate your requests, but cannot guarantee availability. 

8. NextWave will send you a final breakdown of your charter information 1 day prior to the charter including contact information for the crew on the day.

Terms and Conditions:

 

Bookings:

For any confirmed reservations, half of the agreed payment must be settled by the charterer as a non-refundable deposit. The balance must be paid within 7 days before the charter. If the charterer requests cancellation of the reservation, there would be no refund of the deposit.

 

NextWave is responsible to communicate with the primary charterer who organised the charter only, no changes to booking details will be accepted from any other person or member of the charter party, unless the primary charterer has notified NextWave and agreed in advance.

 

The Captain and Company will count the charter time/length, to commence from the agreed upon start time, until the last member of the charter party disembarks and has unloaded all equipments and belongings loaded. Extra charter time will not be granted in the case of late boarding at the fault of the charterers party.

 

All extra charter hours are subject to overtime charges.

 

All payments in regards to extra hours and or fuel charges, are to be settled prior to the charter, directly with NextWave. No payments are to be made in any case, to the on board crew. Crew members will not be held responsible for any cash payments. For any ‘on the day’ charges, credit card details will need to be provided over the phone to a NextWave Charters administrator and will need to be approved before the charter will proceed. 

 

A complete list of passenger names must be submitted to NextWave Charters two days prior to the charter. This is a requirement of the Hong Kong Marine Department and may be requested at any time.

A completed and signed Indemnity Form must be submitted by the charterer to NextWave Charters, two days prior to the charter. 

No charter will be able to proceed without these forms being submitted and received by NextWave Charters. 

 

External and additional electrical equipment (eg. speakers, DJ equipment, etc) are not permitted on any boats without prior approval and written acknowledgement to and from NextWave Charters. Not all boats allow the loading of additional equipment, and some require a security bond. Please ensure you have discussed this and received written approval before arranging any additional equipment.

 

 

General

 

NextWave Charters reserves the right to use photographs taken on charters for promotional purposes. If you do not wish to have photos of your charter taken and or used, please advise NextWave in writing, prior to the charter.
 

No Shoes allow on all the super luxury cruiser onboard, guests must take off their shoes if they are onboard on one of our super luxury cruiser.  

No pets are allowed on the boats.

 

Children are the sole responsibility of their parents/guardians. We do not offer or provide child-minding services, and based on experience to ensure the safety of your children we recommend having at least 1 adult per 2 children to supervise.

 

The Captain of the boat has the sole right for decisions made on board the boat regarding safety and may issue certain directions to staff and guests should a situation arise. The Captain reserves the right to control the music level on board. Following reckless or dangerous behaviour, the Captain reserves the right to return to the pier.

 

Bringing illegal substances or using illegal substances during the boat trip is not allowed. If illegal substances are discovered, the Captain will immediately return to shore and the case reported to the police. No refund or compensation for time lost will be given.

All boat photos shown on our website may be slightly difference from the actual boat due to wore out from the charters. We will try our best to keep the photos up to date.

 

 

Cancellations and Rescheduling  

In the case of cancellations, the deposit paid is non-refundable 

 

For cancellations and re-scheduling requests, the charterer must notify NextWave Charters in writing at least 30 days before the charter day, or will otherwise be responsible for the full payment of the charter and any services booked.

 

Any changes to the booking date will be subject to a $1000 administration fee.

 

Rescheduled charter dates can be changed once only, and must be for the same vessel as originally booked.

 

In the case of the charterer not arriving at the agreed upon boarding pier within two hours of the charter start time, the charter will be considered cancelled. 

 

If the charterer requests to return to the pier before the appointed end time or terminated the charter before charter time, no compensation and refund for the charter will be given. 

 

In any case of charter cancellation or postponement, the charterer will remain responsible for all catering and drinks ordered. NextWave Charters acts only as an agent on the charterers behalf when booking external catering and drinks supplies. For any and all disruptions, the charterer will need to collect the catering and drinks, and remain responsible for their payment. 

 

 

Safety

 

Passengers are solely responsible for their personal safety and that of any property they bring aboard.

 

The charterer is liable and responsible to ensure the licensed passenger capacity of the boat is not exceeded. 

 

In the case of rough weather or for safety reasons, the Captain reserves the right to choose a safer route and/or alternative boarding point. The charterer should also inform the company in advance in case of special arrangement.

 

Be aware of potential dangers on board including tripping hazards, moving parts, ropes and the boom on yachts.  Passengers are advised to wear protective clothing from the sun including long sleeve shirts, hats and sun cream.

 

 

Weather

Good Weather is not guaranteed with the charters!

 

If there is a change in the weather, the captain has the right to choose the safest route to a destination and/or safe location to dock.

 

The following will be applicable in case of the typhoon:

  • The vessel would still set sail if typhoon signal no. 1 or rainstorm amber or red warning is hoisted. There will be no cancellation or postponement even if higher typhoon signal is lowered to typhoon signal no.1 or rainstorm black warning is lowered to rainstorm red warning two hours before the appointed departure time. When the charterer requests to postpone the launch, the re-scheduled launch would only be accepted on a weekday regardless of the original departure day. The charterer is also advised to keep close contact with NextWave.

  • If typhoon signal no. 3 or higher is hoisted while sailing, the Captain can choose to sail the vessel back to the closest pier according to the Marine Ordinance, the safety of guests on board, and safety of the vessel. Under no circumstances will compensation be given in such situations.

  • If typhoon signal no. 3 or rainstorm black warning is hoisted within 2 hours before the charter boarding time, NextWave will make arrangements with the charterer to reschedule. No extra charges will be made for the rescheduling. No refunds will be made. Rescheduled date will be based on availability, and must be made within 3 months following the original charter date.

  • In case of bad weather, it will affect the sea conditions and longer sail time to the destination are expected.  

  • If the craft cannot reach the appointed boarding pier, the charterer should board from a suggested alternative pier. NextWave will only compensate for all the travelling expenses between the appointed and suggested pier.

Please understand our business is very seasonal, we can't cancel or re-schedule charters unless it is T3 or above or black rain. We understand you may not be happy to go out during bad weather, but consider we run a seasonal business it also affected our business a lot. To able to keep our business running please kindly understand our situation, it is not easy for us to cancel a charter. 

 

 

Catering and Beverages 

 

Catering and drinks orders must be placed 14 days before the charter day. Once confirmed in writing, no changes can be made, and the charterer shall bear responsibility for catering payment.

 

Vessel hire does not include catering or kitchen accessories, including plates, cutlery, and cups. These items are the responsibility of the charterer.

 

In any case, the charterer will remain responsible for all catering and drinks ordered. NextWave Charters acts only as an agent on the charterers behalf when booking external catering and drinks supplies. For any and all disruptions, the charterer will need to collect the catering and drinks, and remain responsible for their payment. 

 

 

Boarding, Disembarking and Destinations

 

The passengers are assumed to embark and disembark at the same point unless organised otherwise. If special arrangements have to be made, they should be discussed beforehand with NextWave and might incur additional costs. 
 

All boats will dock at the pier one time for pick up and drop off guests, Extra docking for pick up and drop off additional costs applied. 

 

Some destinations may incur an extra fuel charge based on their mooring location, your pick up point, drop off point and destination request. Destination requests and any extra charges must be settled prior to the charter.  

 

The Captain has the right to change the destination if the weather is unfavourable, but will communicate this with the charterer, and provide the best options based on safety and comfort for passengers based on wind direction. 

 

The vessel is to remain within Hong Kong waters at all times, unless paperwork and arrangements for international travel have been made prior to the charter. 

 

 

Damages

 

The charterer should make sure all furniture and equipment on board are in the same condition at disembarkation, as when they boarded. The charterer will be responsible for any damage caused by any of his party member. All equipment or facilities should be used under any applicable regulation of Hong Kong or the instruction of the person held responsible for the vessel on the date of the launch. The charterer will hold sole responsibility for compensation of all damages or injury caused by the violation of such rules.

 

All vessels are insured according to the law of Hong Kong. The charterer will carry sole responsibility for the passengers and passengers property and neither NextWave nor any of its officers, servants or Agents nor any vessel shall be reliable for any loss or damage to property or loss of life or personal injury whether through negligence or any other cause while on board of any craft or while boarding or disembarking from any vessel or other activity and whenever. NextWave will not be held responsible for any loss or damage but will report incidences to the Police.

 

 

Mechanical Problems

 

If the engine fails prior to charter and cannot be repaired before boarding, the company will inform the charterer as soon as possible. An alternative vessel will be provided as quick as reasonably possible and if no vessel is available, a re-scheduled charter date will be guaranteed within 6 months of the original charter date. The charterer will take possession of any and all catering on the day of the original charter, and will need to re-order for the rescheduled date.

 

If the engine fails during the charter, the Captain stall try his or her best to alleviate the problem. If this is not possible, the captain will make arrangements to take passengers back to shore. In regards to the possibility of compensation, in the form of a reduced rate additional charter date, arrangements will be made between NextWave and the charterer on the first working day after the charter. The Captain's focus is the safety of the boat and its guests, and will not be responsible for any negotiations with the charterer.

If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail
